THIS SOFTWARE PRODUCT, IDENTIFIED ABOVE, IS MARKETED UNDER THE SHAREWARE CONCEPT AND IS PROTECTED BY COPYRIGHT LAWS AND INTERNATIONAL COPYRIGHT TREATIES, AS WELL AS OTHER INTELLECTUAL PROPERTY LAWS AND TREATIES. THE SOFTWARE PRODUCT IS LICENSED, NOT SOLD.
You (either an individual or a single entity) are given the right use one (1) copy, and one copy only, of this software product, as if you had purchased a Single License for that copy of the software product, for a period NOT EXCEEDING a period of thirty (30) days from when the copy of the program was first installed. This temporary license granted to you is further referred to as the TEMPORARY EVALUATION LICENSE.
The usage of the software product is subject to all conditions and agreements stated in the LICENSE AGREEMENT below, AT ALL TIMES.
If you wish to continue to use the software product after the TEMPORARY EVALUATION LICENSE has expired, YOU MUST PURCHASE A LICENSE (ie: pay the registration fee) There are two differed types of licenses available, namely a SINGLE LICENSE and a SITE LICENSE.
SINGLE LICENSE:
This type of license will give you the right to use one (1) copy of the software product, either of the current version or of any future version, for every SINGLE LICENSE purchased.
SITE LICENSE:
This type of license will give you the right to use unlimited copies of the software product for every site license held, but subject to the following conditions:
1) The copies can only be used on computer systems located at premises that can reasonable be considered to be part of the same site.
2) The copies can only be used on computer systems located at premises that are used directly by you (either an individual or a single entity).
If you do not purchase a license for this software product when the TEMPORARY EVALUATION LICENSE has expired, YOU MUST PROMPTLY DESTROY ALL COPIES of this software product in your possession, regardless of where they are located.
Later versions of the software product are regarded as having their own TEMPORARY EVALUATION LICENSE and you are given the right to install and use them according to their own TEMPORARY EVALUATION LICENSE conditions.
LICENSE AGREEMENT:
DESCRIPTION:
This License Agreement is a legal agreement between you (either an individual or a single entity) and A.T. Ceuls for the software product identified above, which includes computer software and associated media and printed materials (if any), and may include on line or electronic documentation (software product or software). By installing, copying, or otherwise using the software product, you agree to be bound by the terms of this License Agreement. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU ARE NOT AUTHORIZED TO USE THE SOFTWARE PRODUCT.
GRANT OF LICENSE:
This License Agreement grants you the following rights:
1) A.T. Ceuls grants to you the right to use this software product according to the conditions of the type of license held.
2) You may install copies of the software product for use on all computers which are covered by the type of license you hold.
3) You may make copies of the software product for backup and archiving reasons.
RESTRICTIONS:
1) You must maintain all copyright notices on all copies of the software product.
2) You may use the registration information for copies where it legally can be used for only.
3) You may not reverse engineer, decompile, or disassemble the software product, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
3) You may not rent, lease or sell the software product or any license for the software product, these rights stay with A.T. Ceuls or A.T. Ceuls' delegates at all times.
TERMINATION:
A.T. Ceuls may revoke any licenses you own for the software product at any time if you fail to comply with the terms and conditions of this License Agreement. In such event, you must promptly destroy all copies of the software product in your possession, regardless of where they are located.
COPYRIGHT:
All titles and copyrights pertaining to the software product and any copies thereof are owned by A.T. Ceuls. All title and intellectual property rights pertaining to the content which may be accessed through use of the software product is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This License Agreement grants you no rights to use such content.
WARRANTY:
No warranty of any kind, implied or otherwise is supplied with this software product. Any use of this software product is totally at your own risk. Also, to the maximum extent permitted by applicable law, A.T. Ceuls disclaims all warranties and conditions, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular Description, and non infringement.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES:
To the maximum extent permitted by applicable law, in no event shall A.T. Ceuls or A.T. Ceuls' suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use the software product, even if A.T. Ceuls has been advised of the possibility of such damages. Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
LIMITATION OF LIABILITY:
A.T. Ceuls' entire liability and your exclusive remedy under this License Agreement shall not exceed the value of one ($1.00) US dollar.
DISCLAIMER:
By using Handy Spell or any of it associated files (further referred to as the software product) you, the user, implicitly acknowledges and agrees that neither A.T. Ceuls or A.T. Ceuls' employees or suppliers, accept any responsibilities, or are liable, for damages, or loss of any kind, resulting from the use of this software product and make no warranty or representation, either expressed or implied, including but not limited to, any implied warranty of merchantability or fitness for a particular description or purpose.
The software product is provided "AS IS", and you, its user, who assumes ALL risks when using it.
